1. Introduction
These Terms and Conditions (“Terms”) govern the use of the Support My Team platform (“Platform”), operated by Support My Team Ltd (company number 12889661 registered in England & Wales). By registering as a club (“Organisation”) on our Platform, you agree to these Terms.
2. Service Description
Our Platform provides Organisations the ability to raise funds by hosting monthly online raffles. Subscribers to your Organisation’s page pay a monthly subscription fee, which entitles them to a set number of raffle tickets for each monthly draw.
3. Eligibility and Registration
- Organisations must be legally registered clubs, schools, or charities in the UK.
- You must provide accurate and up-to-date information during registration.
4. Raffle Operations
- Raffles are conducted at least once a month and are dealt with by the Organisation via the online Platform.
- The Platform manages ticket allocation, payment collection, and winner selection using a random process (operated by you).
- Prizes and draw dates are set in advance and clearly communicated to subscribers by the Organisation.
- All raffles are operated in compliance with UK gambling and fundraising laws; it is the Organisation’s responsibility to ensure they have the correct licence in place.
5. Subscription and Payments
- Subscribers pay a recurring monthly fee for raffle tickets.
- The Platform collects and processes payments securely.
- Platform fees and payment processing charges will be deducted before funds are distributed to the Organisation.
- Payouts to Organisations are processed monthly and require a valid UK bank account.
5.1 Clawbacks and Recovery of Funds
- If a supporter, or their bank successfully requests a refund, chargeback, reversal or other clawback (a “Clawback”) for any payment collected on behalf of an Organisation, Support My Team reserves the right to recover the amount of the Clawback and any associated fees, costs or losses (including bank or card scheme chargeback fees) paid by Support My Team.
- Support My Team may recover such amounts by: (a) debiting the Organisation’s account on the Platform; (b) offsetting the amount against any future payouts or funds due to the Organisation; and/or (c) seeking reimbursement from the Organisation by requesting payment to Support My Team’s nominated bank account.
- The Organisation agrees to cooperate with Support My Team in investigating Clawbacks and to provide all reasonably requested documentation and information. If the Organisation provides timely evidence that a Clawback is invalid and Support My Team is able to recover the funds from the payer or bank, Support My Team will promptly return any amounts wrongly recovered.
- If the Organisation fails to reimburse a valid Clawback within 14 days of Support My Team’s written demand, Support My Team may charge interest on the outstanding amount at the rate of 8% above the Bank of England base rate and take any other recovery action permitted by law.
- The Organisation remains responsible for ensuring payments collected are legitimate and for complying with any applicable rules and licensing; Support My Team shall not be liable for sums recovered from Organisations pursuant to this clause.
6. Organisation Responsibilities
- Organisations agree to use funds raised solely for their stated charitable, educational, or club purposes.
- Organisations must not misrepresent their cause or fundraising goals.
- Organisations are responsible for ensuring their fundraising activities comply with all applicable laws and regulations.
- Organisations must cooperate with Support My Team in relation to any Clawback inquiries and reimburse valid Clawbacks in accordance with Section 5.1.
7. Platform Responsibilities
- The Platform will provide technical support, payment processing, and raffle management.
- The Platform will not be liable for any misuse of funds by Organisations.
8. Data Protection and Privacy
- The Platform collects and processes personal data in accordance with our Privacy Policy and UK GDPR.
- The Platform is registered with the Information Commissioner’s Office (registration number ZB072067).
9. Intellectual Property
- Organisations may use Platform branding and promotional materials as provided.
10. Cancellation and Termination
- Organisation Cancellation: Teams may cancel their account at any time by providing 30 days’ written notice to the Platform. During this notice period, any scheduled raffles will continue as planned unless otherwise agreed.
- Subscriber Cancellation: Subscribers may cancel their subscription at any time through their online account. Upon cancellation, no further payments will be taken, but the subscriber will continue to receive raffle entries for any period already paid for.
11. Termination by Platform
- The Platform reserves the right to suspend or terminate an Organisation’s account for breach of these Terms or unlawful activity.
- The Organisation may close their account at any time by providing written notice, subject to the 30-day notice period above.
12. Limitation of Liability
- The Platform is not liable for indirect or consequential losses.
13. Changes to Terms
- The Platform may update these Terms from time to time. Significant changes will be communicated in advance.
14. Governing Law
- These Terms are governed by the laws of England and Wales.
